The IAS Fitness Center is provided for the beneficial use of the Faculty, Members, and Staff of the Institute. It is an unsupervised facility where various types of exercise equipment will be operated. It is neither a recreational facility for children nor an appropiate center for extensive body building such as that required to prepare for contact sports; instead it is a fitness center where adults can go to maintain or improve their health. Everyone is asked to employ appropriate precautions when using the equipment to avoid injury to oneself or to another. The following waiver must be signed by anyone who wishes to use the center.
WAIVER
I hereby apply to use the fitness center at the Institute for Advanced Study, Princeton, NJ (Institute). I represent that I am over the age of 18 years and that I am in adequate physical condition to use these facilities and equipment. I understand that the Institute takes no responsibility for verifying my physical readiness for use of the equipment in the fitness center. I take full responsibility for my health and fitness. If I have any questions regarding my physical ability to operate the equipment, I agree to check with my physician and discuss my proposed participation in any exercise programs. I have received no current medical advice recommending against the use of these or similar facilities and equipment.
I understand that the fitness center is not supervised and that I will be alone in it. I represent that I know how to use the facilities and equipment and that I will use them safely.
I further understand that the fitness center has been constructed for the use of members of the Institute Community. I will not allow anyone under the age of 18 years to accompany me into the fitness center or anyone over 18 years of age who has not signed this waiver. In consideration of the Institute's allowing me to use the fitness center, whether or not I see my physician prior to doing so, I hereby release the Trustees of the Institute for Advanced Study and waive all claims against the Institute, its officers, agents, or employees for damages or loss to my person or property that may occur while using the fitness center, or which may be caused by any act or failure to act by the Institute, its officers, agents, or employees. I assume the risk of all dangerous conditions in and about the fitness center and waive any and all specific notice of the existence of such conditions.
I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by using the fitness center; and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand the risk of becoming exposed to or infected by COVID-19 by using the fitness center may result from the actions, omissions, or negligence of myself, others, including but not limited to, Institute Staff, Faculty, and Members. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including but not limited to personal injury, disability and death) illness, damage, loss, claim, liability, or expense of any kind that I may experience or incur by using the fitness center. I hereby release, covenant not to sue, discharge, indemnify and hold harmless the Institute of and from any claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of the Institute, whether a COVID-19 infection occurs before, during or after using the fitness center. No oral communication may change, alter or affect the validity of the waiver.
